I, PARTICIPANT, know, or have been advised, of the risks of participation in the roller sport of competitive artistic roller skating, competitive inline speed skating, competitive quad speed skating, roller hockey, roller derby or jam skating, and further know, or have been advised, of the possibility of mechanical and/or equipment malfunction which malfunction could occur as a result of the negligence of WYMER FUNSPOT LLC (DBA JUMPIN’ JUPITER SKATE CENTER) or independent of the negligence of WYMER FUNSPOT LLC (DBA JUMPIN’ JUPITER SKATE CENTER) or otherwise, as well as the possibility of injury and/or death to my person as a result of my participation in one or more of the aforementioned roller sport activities;
I, PARTICIPANT, further understand and appreciate the aforementioned risks of personal injury and/or death as a result of my participation in one or more of the aforementioned roller sport activities and further understand and appreciate the serious consequences which might result in the event of personal injury and/or death due to my involvement in one or more of the aforementioned roller sport activities, while training with and/or at the direction of WYMER FUNSPOT LLC (DBA JUMPIN’ JUPITER SKATE CENTER) AND/OR COACH, and with that knowledge, understanding and appreciation of the aforementioned risks hereby VOLUNTARILY ASSUME ANY AND ALL RISK OF LOSS, DAMAGE AND/OR INJURY OF ANY KIND WHATSOEVER, INCLUDING DEATH, AS A RESULT OF MY PARTICIPATION IN ONE OR MORE OF THE AFOREMENTIONED ROLLER SPORT ACTIVITIES WHICH MAY OR MAY NOT BE IN CONJUNCTION WITH TRAINING AT THE DIRECTION OF COACHES EMPLOYED BY OR INDEPENDENT CONTRACTORS ASSOCIATED WITH WYMER FUNSPOT LLC (DBA JUMPIN’ JUPITER SKATE CENTER).
I, PARTICIPANT, on behalf of myself, my heirs, executors and administrators, do hereby RELEASE AND FOREVER DISCHARGE WYMER FUNSPOT LLC (DBA JUMPIN’ JUPITER SKATE CENTER), its owners, employees, agents, including its coaches, from any and all claims, demands, damages, rights of action, or causes of action, present or future, whether same be known or unknown, anticipated, or unanticipated, resulting from or arising out of the aforementioned risks which risks I fully know, acknowledge and appreciate include the risk of injury due to the negligence of WYMER FUNSPOT LLC (DBA JUMPIN’ JUPITER SKATE CENTER) and its employees which may include coaches both employed or independently retained by WYMER FUNSPOT LLC (DBA JUMPIN’ JUPITER SKATE CENTER).
I, PARTICIPANT, further represent and affirm that I am physically sound and have medical approval to participate in one or more of the aforementioned roller sport activities which may be at the direction of WYMER FUNSPOT LLC (DBA JUMPIN’ JUPITER SKATE CENTER) AND/OR COACH. That I shall undertake all such activity in recognition of the fact that I have voluntarily assumed any and all risk of loss, damage, or injury including death as a result of such activity. That I am in good health and I have no physical conditions that would be aggravated by my involvement in one or more of the aforementioned roller sport activities/events, nor do I have any physical limitations that would preclude said involvement.
I, PARTICIPANT, having read the above and in exchange for my opportunity to participate in one or more of the roller sport activities/events named above with and/or at the direction of WYMER FUNSPOT LLC (DBA JUMPIN’ JUPITER SKATE CENTER) AND/OR COACH, do hereby RELEASE AND FOREVER DISCHARGEWYMER FUNSPOT LLC (DBA JUMPIN’ JUPITER SKATE CENTER) WYMER FUNSPOT LLC (DBA JUMPIN’ JUPITER SKATE CENTER)AND/OR COACH from any and all liability for their own negligence or defects in equipment which could result in injury, injuries from dangerous conditions on the premises, whether or not known to WYMER FUNSPOT LLC (DBA JUMPIN’ JUPITER SKATE CENTER) and hereby voluntarily assume any and all risk of loss, damage or injury of any kind whatsoever including death which may result from any alleged negligence of WYMER FUNSPOT LLC (DBA JUMPIN’ JUPITER SKATE CENTER)AND/OR COACH, defects in equipment provided by WYMER FUNSPOT LLC (DBA JUMPIN’ JUPITER SKATE CENTER) or injuries from dangerous conditions on the premises of WYMER FUNSPOT LLC (DBA JUMPIN’ JUPITER SKATE CENTER).
CERTIFICATION OF GOOD HEALTH
I certify that I am in good physical condition and is physically and psychologically prepared to participate in this program. I hereby give my consent to WYMER FUNSPOT LLC (DBA JUMPIN’ JUPITER SKATE CENTER) to provide through staff of it’s choice, customary medical/athletic training attention, transportation and emergency medical services as warranted in the course of my participation.
UNDERSTANDING OF RISK
I understand the seriousness of the risks involved in participating in this program, my personal responsibilities for adhering to rules and regulations, and accept them as a participant.
I have read the above and by my signature below acknowledge that I know, understand and appreciate the legal significance of these terms and intend to be bound by them.
